Court overturns Marchica demolition orders and license cancellations in Nador

On Thursday April 9, the court issued two final judicial rulings in two administrative cases that had sparked widespread controversy, as the judicial body decided to annul administrative decisions issued by the local authority, while ordering all the resulting legal consequences to be implemented.

In the first case, the court ruled publicly, at first instance, and in the presence of the parties, to accept the appeal on procedural grounds, and on the merits, to annul demolition decision No. 03/2025, issued on September 25, 2025, by the head of the third administrative district of Nador, considering that the contested decision lacked a sound legal basis, which necessitated its annulment.

In the second case, the court ruled to accept the original appeal on procedural grounds, while rejecting the subrogation forgery appeal; on the merits, it ruled to annul Decision No. 03 dated September 18, 2025, which effectively canceled Permit No. 37 dated April 13, 2023, with all the legal consequences thereof.

During the process of adjudicating the two cases, the court held several decisive sessions, including the session of November 13, dedicated to the exchange of written memoranda between the parties, followed by the session of November 20 for deliberation, before the proceedings concluded with the session of November 27, during which the initial final ruling was issued.

The information confirmed that the judicial panel based its decisions on a thorough study of all documents and memoranda, concluding that the elements of seriousness and urgency were present, which justified judicial intervention to annul the contested administrative decisions, in order to protect rights and ensure respect for the rule of law.

These rulings revive the debate over the extent to which legal procedures are respected when issuing administrative decisions, especially those related to urban planning and demolition, particularly as affected parties increasingly turn to the administrative judiciary to obtain justice.
